Folio & Minealex Games Terms of Service

1. Acceptance of Terms

By accessing, downloading, installing, or using the Minealex Games website, the Folio application, or any associated services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must discontinue using our services.

2. Application License & Data Ownership (Local-First)

2.1 Folio License Grant & Open Source Ownership

We grant you a personal, worldwide, non-exclusive license to install and run the Folio application on your devices. Although Folio is developed openly (Open Source), all project intellectual property, registered trademarks, logos, commercial branding, and visual designs remain the exclusive property of Minealex Games (Alex).

2.2 Complete Ownership of Your Content

All content you create, import, or store inside your vault (AES-256-GCM encrypted)—including notes, pages, canvases, task lists, databases, and audio recordings—remains exclusively your property. Minealex Games claims zero copyright, ownership, or control over your data.

2.3 Local Custodian Responsibility

Folio is engineered under a Local-First philosophy: your data physically resides on your local device. You are the sole custodian of your encryption keys and unlock passkeys. Minealex Games does not store your keys and cannot recover your encrypted vault if credentials are lost.

3. Quill AI Assistant & Acceptable Use

3.1 Responsible AI Usage (EU AI Act)

The Quill AI Assistant is provided as a productivity enhancement tool. Using Quill to generate illegal, defamatory, harassing, or infringing content is strictly prohibited.

  • Local On-Device Models (Ollama/LM Studio): Inference running on local models executes on your own hardware under your sole responsibility.
  • Quill Cloud / BYOK: When connecting remote inference endpoints or custom API keys (OpenAI, Gemini), you agree to comply with the terms of service of those respective providers.

3.2 Malicious Reverse Engineering Ban

Decompiling, maliciously reverse-engineering, or exploiting security vulnerabilities in Folio Cloud backend services or licensing infrastructure is strictly prohibited.

4. User Accounts, Subscriptions, and Payments

4.1 Authentication (Patreon & Folio Accounts)

To access optional Folio Cloud features, multi-device cloud sync, or Patreon tier perks, you must maintain an active account and secure login credentials.

4.2 Billing and Refunds (Stripe / Microsoft Store)

Folio Cloud subscriptions and Ink credit top-ups are processed securely via Stripe or the official Microsoft Store API. You may cancel your subscription at any time via your billing portal or Patreon account.

5. Third-Party Services & Web Publishing

Folio allows optional integration with external storage providers (NAS, WebDAV) and a 'Publish to Web' feature. When publishing a page to the web, you represent that you possess all necessary rights to share that content publicly.

6. Disclaimer of Warranties & Limitation of Liability

Minealex Games provides the Folio application and website on an 'AS IS' and 'AS AVAILABLE' basis. To the maximum extent permitted by law, we are not liable for accidental data loss resulting from local hardware failures, lost encryption keys by the user, or third-party service outages.

7. Changes to Terms & Contact

We reserve the right to modify these terms to reflect new Folio features or regulatory requirements. Updates will be published on this website with an updated revision date.

Note on Local-First Architecture: Folio is engineered to ensure your data is never locked into a proprietary cloud server. You can export or backup your complete encrypted vault at any time in open standard formats.
